These Terms of Service ("Terms") govern your access to and use of the website suksessllc.com and the transportation and logistics services provided by Suksess LLC ("Suksess," "we," "us," or "our"). By using our website or requesting our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website and services, you represent that you: (a) are at least 18 years old; (b) have the legal capacity to enter into a binding agreement; and (c) agree to comply with all applicable laws and regulations.

2. Description of Services

Suksess LLC provides transportation and logistics services across the 48 contiguous United States, including:

All services are subject to availability, equipment compatibility, lane coverage, applicable laws, USDOT/FMCSA regulations, and the terms of a separate Carrier Agreement or Broker-Carrier Agreement executed for each shipment.

3. Quote Requests Are Not Binding Contracts

A quote request submitted through our website or other channels is an inquiry only. No binding contract is formed until both parties execute a written agreement (such as a Bill of Lading, Rate Confirmation, or Carrier Agreement) and we confirm acceptance of the load. Rates quoted are estimates based on the information provided and may change based on actual weight, dimensions, route, fuel surcharges, accessorial services, market conditions, and other factors.

4. Customer Responsibilities

You agree to:

5. Prohibited Items

We do not transport: illegal substances; explosives or weapons (except as expressly agreed in writing and properly classified); live animals; human remains; counterfeit goods; or any cargo not properly documented or compliant with federal law. Hazmat freight requires advance written notification and proper placarding.

6. Cargo Liability & Insurance

Suksess LLC maintains cargo insurance, auto liability insurance, and general liability insurance as required by USDOT/FMCSA regulations. Cargo liability is governed by the Carmack Amendment (49 U.S.C. § 14706) and applicable terms set forth in the executed Bill of Lading or Rate Confirmation. We are not liable for: acts of God; war or civil unrest; defects inherent in the cargo; improper packaging by shipper; or delays caused by circumstances beyond our reasonable control.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall Suksess LLC, its owners, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) arising out of or related to your use of this website or our services, even if we have been advised of the possibility of such damages. Our maximum aggregate liability for any claim shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim, except where such limitation is prohibited by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Suksess LLC and its owners, employees, contractors, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your: (a) violation of these Terms; (b) misrepresentation of cargo; (c) violation of applicable laws; or (d) infringement of any third-party rights.
